According to court documents uncovered by Voodoo Extreme, the title had been handed off to a third-party developer, and was to have been released in mid-2010. However, the title was mysteriously suspended earlier this year.
3D Realms alleges that the title was axed to restrict their income, which would have allowed Take-Two to purchase the rights to Duke Nukem at a lower cost. At that point, they apparently believed that 3D Realms would have been desperate for any cash to keep their studio afloat.
Allegations of this sort have flown back and forth since 3D Realms axed the entire Duke Nukem Forever development team back in May. Among other things, 3D Realms claimed that Take-Two never paid any of its due advances, while Take-Two claimed that the developer was holding money in an offshore oil account.
Take-Two is currently suing 3D Realms for $12 million for having not completed Duke Nukem Forever. The case should go to trial in about a year.
